By accessing or using the website located at www.mrnailhead.com (the "Site"), requesting a quote, signing a project agreement, or engaging the services of MNH, LLC, doing business as MrNailHead ("Company," "we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not use this Site or engage our services.
These Terms apply to all visitors, clients, and prospective clients who access the Site or engage MNH, LLC for design and renovation services in Florida, Georgia, or any other jurisdiction in which the Company operates.
MrNailHead is a luxury design and renovation firm headquartered in Florida with operations in Georgia. We curate and orchestrate premium residential and commercial transformation projects — from concept development through final installation — for discerning homeowners, condominium owners, absentee investors, and property stakeholders across the Gulf Coast, 30A/Panama City Beach corridor, and Metro Atlanta markets.
MNH, LLC holds the following state-issued credentials, presented here as protection for our clients' investments:
• Florida: Certified Building Contractor License No. CBC1270007
• Georgia: Residential/Basic Contractor License No. RBCO007172
MrNailHead provides luxury remodeling, renovation, and design orchestration services as more fully described in individual project agreements, proposals, or statements of work ("Project Agreement") executed between MNH, LLC and each client.
These Terms govern general access to the Site and the overall client relationship. Specific project deliverables, timelines, material specifications, and pricing are governed by the applicable Project Agreement. In the event of a conflict between these Terms and a signed Project Agreement, the Project Agreement controls.
We reserve the right to decline any project inquiry at our sole discretion.
All quotes, proposals, and project estimates provided by MNH, LLC — whether submitted via the Site, email, or in person — are non-binding until formalized in a signed Project Agreement. Estimates are based on information available at the time of assessment and are subject to revision upon discovery of unforeseen site conditions, material price changes, or modifications to the project scope.
Quotes are valid for thirty (30) days from the date of issuance unless otherwise stated in writing. After thirty (30) days, pricing and availability are subject to change.
Any changes to the project scope, materials, design selections, or timeline must be documented in a written change order signed by both parties. Verbal authorizations do not constitute binding change orders.
Change orders may affect the overall project price, schedule, and material lead times. MNH, LLC will provide a written change order describing the impact on cost and schedule before proceeding with any scope change.
To enable successful project delivery, the client agrees to:
• Provide accurate, timely information regarding the property, access requirements, HOA restrictions, and applicable permits.
• Make all required decisions and approvals in a timely manner so as not to delay the project schedule.
• Ensure that the Company and its subcontractors have appropriate, safe, and unobstructed access to the project site during agreed-upon work hours.
• Notify the Company of any known hazardous conditions, including but not limited to mold, asbestos, lead paint, or structural deficiencies.
• Obtain any required HOA or condominium association approvals prior to or concurrent with the permitting process.
Client's failure to fulfill these responsibilities may result in project delays, additional costs, or suspension of work, for which MNH, LLC shall not be liable.
All design concepts, renderings, mood boards, specifications, photography, written content, logos, branding, and other creative materials produced by MNH, LLC or on its behalf are the intellectual property of MNH, LLC until full payment has been received, at which time ownership of project-specific deliverables transfers to the client as specified in the Project Agreement.
Content on the Site — including photographs, text, graphics, and logos — remains the exclusive property of MNH, LLC. You may not reproduce, distribute, or use any Site content without prior written consent from MNH, LLC.
MNH, LLC warrants that all work will be performed in a workmanlike manner, consistent with industry standards for luxury renovation, using materials specified in the Project Agreement. Warranty terms specific to labor and materials are set forth in the applicable Project Agreement.
THE SITE AND ALL INFORMATION CONTAINED THEREIN ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. MNH, LLC MAKES NO WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Manufacturer warranties on products and materials pass through to the client and are subject to each manufacturer's individual warranty terms.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MNH, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, OR BUSINESS INTERRUPTION, EVEN IF MNH, LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL THE TOTAL CUMULATIVE LIABILITY OF MNH, LLC TO YOU EXCEED THE TOTAL AMOUNT PAID BY YOU TO MNH, LLC UNDER THE APPLICABLE PROJECT AGREEMENT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
Some states do not allow limitation of certain damages, so some of the above limitations may not apply to you.
You agree to indemnify, defend, and hold harmless MNH, LLC, its members, managers, employees, agents, licensors, and suppliers from and against all claims, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your breach of these Terms; (c) information or materials you submit to MNH, LLC; or (d) your violation of any applicable law or third-party right.
The Site may contain links to third-party websites or resources for your convenience. MNH, LLC does not endorse and is not responsible for the content, products, or services of any third-party sites. Accessing third-party sites is at your own risk, and you should review their respective terms and privacy policies.
These Terms and any dispute arising out of or related to the Site or services provided in the State of Florida shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict-of-law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in Walton County or Bay County, Florida, for resolution of any such dispute.
For projects performed in the State of Georgia, any dispute arising out of or related to services shall be governed by Georgia law. You consent to the jurisdiction of the state courts located in Fulton County, Georgia, for resolution of any such dispute.
In the event of a dispute between MNH, LLC and a client, the parties agree to first attempt resolution through good-faith negotiation. If negotiation is unsuccessful within thirty (30) days, the parties agree to submit the dispute to non-binding mediation before a mutually agreed mediator as a prerequisite to initiating any legal proceeding.
Nothing in this section prevents either party from seeking emergency injunctive or other equitable relief from a court of competent jurisdiction where necessary to prevent irreparable harm.
Either party may terminate a Project Agreement in accordance with the termination provisions set forth therein. MNH, LLC reserves the right to terminate your access to the Site at any time, for any reason, without notice.
Upon termination of a project, the client shall be responsible for payment of all work performed and materials ordered or procured up to the date of termination, plus any restocking, cancellation, or demobilization costs incurred by MNH, LLC.
Your use of the Site is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and disclosure of your personal information.
MNH, LLC reserves the right to update or modify these Terms at any time without prior notice. The revised Terms will be posted on the Site with an updated effective date. Your continued use of the Site or our services following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
These Terms, together with the applicable Project Agreement and Privacy Policy, constitute the entire agreement between you and MNH, LLC with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, representations, and understandings of the parties.
